sorry lads, but saying that bloke should either pay or send back the item is not covered by law nor small claims court.
by law, if unsolicited goods is sent to YOUR address, its then gives YOU the right to own it.
the NEW owner have the rights to do whatever he/she wants with the goods that was sent to him/her by human error, its only when him/her has bought the goods but was sent a wrong item by the seller where he/she HAS to send the wrong item back to seller in return for the correct item(s).
for example, if someone sent a letter/goods to my address with or without a name by mistake, i have the rights to open it up, make copies of it, sell it on, or post it on the web and no one can do me in LEGALLY.
i've had this kind of things happens to me a lot of times, confidential letters, goods sent to my address etc.....and i've asked me barrister about the laws of it.....and as long as i didnt ask for/involved money for this item, then theres nothing you can do......BECAUSE IT WAS THE SENDER FAULT-he/she should have made sure the correct address and name was written before the goods were sent, thats it, no one eles to blame.
if that bloke is bright enough, he'll in return do you in for threat or harassment.
anyway.....thats cleared up on the law side of things.......i do wish you good luck for getting the card back.
