To bad i dont know UK laws, this guy is just rediculous to the extrme. He just wanted a quick buck with his buddy. Also, if what im reading is correct, you can get his buddy too because he was the one that sold it.

QFT, Wiki is a publicly written source and can have many flaws. AHAHHAHAH to this.

Surely you can get on wiki and change it to say "i own your ass"

Personally, I would be suspicious of anyone who says they sold it at a car booty straight away. Oh when I think of all the times I have bought computer parts froma car booty without seeing them working.

It sounds more like "tell him you sold it at a car booty and have not got the address of teh person you sold it to, that way he cant prove that it is in your mates machine."

He must have received the letter this morning because I recieved this e-mail from him:

HI Sam,

As previously confirmed I do consider this matter closed, however I made an agreement with the 2nd caller that next time I saw my friend I would see if he still has the money, amazingly he still has some of it - although I am not legally obligated to do so I feel it is the right thing to do and also I am a man of my word - I now have 55 pounds of the original 60 which I can make available to yourself - please let me know wether you would like this - as if not i would like to return the money to my friend ASAP.

At first I would have happily taken that from him but now with all his lies etc I am not too sure.
 
Sounds like he is flapping.

The card was sold for £120, you need to recover the card or £120. Tell him that is the only deal you can be happy with.

Have you sought REAL legal advice, from a law firm? If not do so.

Small Claims might have to happen, but you need to find out now if it would be better to take the money now, or if you have him, in which case, you can politely tell him to stick it :D
 
TBH man, hes trying to get the card off you for £60-£55 (originally £30).

If you look, hes slowly upping the price as in trying to get the card off you for as cheap as possible. I highly doubt he sold it at a car boot sale.

I think if you keep the pressure on him, he will crack and you will get the full £120. I doubt he sold it at a carboot sale or anything, so you might even get the card back.

sorry lads, but saying that bloke should either pay or send back the item is not covered by law nor small claims court.

by law, if unsolicited goods is sent to YOUR address, its then gives YOU the right to own it.

the NEW owner have the rights to do whatever he/she wants with the goods that was sent to him/her by human error, its only when him/her has bought the goods but was sent a wrong item by the seller where he/she HAS to send the wrong item back to seller in return for the correct item(s).

for example, if someone sent a letter/goods to my address with or without a name by mistake, i have the rights to open it up, make copies of it, sell it on, or post it on the web and no one can do me in LEGALLY.

i've had this kind of things happens to me a lot of times, confidential letters, goods sent to my address etc.....and i've asked me barrister about the laws of it.....and as long as i didnt ask for/involved money for this item, then theres nothing you can do......BECAUSE IT WAS THE SENDER FAULT-he/she should have made sure the correct address and name was written before the goods were sent, thats it, no one eles to blame.

if that bloke is bright enough, he'll in return do you in for threat or harassment.

anyway.....thats cleared up on the law side of things.......i do wish you good luck for getting the card back.
 
I've seen the e-mails and heard the phone calls and this guy is an utter @@}"$!"(*

If it was me I'd have kept the card and not said any thing till I was contacted and at that point would have asked for the money to post it onto the correct person.

The card arrived at the guy’s house on Friday but had to collect it from the PO on Saturday and on Sunday sold :S LIES!!! IMO
 
How the foock can he only get £55 of £60.. wtf..?? surely you would just put and extra £5 in there from his pocket.. Keep on at him abit longer, but by law i dont think you have the rights over the card, He did.

Anyway you should drive down to his address and his 'friends' address and search for the card. I bet its in his machine or his mates.
 
Lol. Hes definately Bull****tin you dont get an 1900XTX in the post pick it up then sell it straight away. And if he uses PC's surely he would know how much that thing is worth. Check Ebay.

After taking advice I have been advised that as I have already offered you the 55 I should just offer you the original 60 pounds you requested for your mistake.

I have now transfered 60 pounds to your paypal account - this is what you have requested in your mail(attached).

The e-mail he attached was one of the first ones I sent to him before he came with all his lies when I requested the £60 back, now that it has gone on so long and he denied me of it at first I am not willing to accept that ammount. He sent me £60 via paypal without asking me first, should I refund it and explain I either want the full ammount as stated in the letter or a return of the card.
 
Keep the 60 while you work things out.

Tell him you want the full amount or the card and that that email is old and the situation changed.
 
Good news everyone, as some of you may already know I received £60 from Mr Green on Saturday and was taking a bit of time to consider what to do with the cash. I got home on Sunday night to find an e-mail from paypal stating another £60 had been sent to me by Mr Green :eek: !!

There was a note with the paypal receipt saying the following:

Although our situation is resolved in my eyes, I still see fit to send this 60 pounds as a gesture of goodwill and should ensure you haven't lost out due to your mistake, also you probably need it more than I do - I had intended to do this on pay day however I am now in a financial position to do so due to both of my auctions doing better than expected hence having some 'free' money.

The events that I said happened are actually the truth as strange as it may sound - should I have been a less discerning member of the public i would have just said box was empty, you may remember watchdog doing a whole piece on papal a while back.

I'm sure from now on you will double check all parcels before sending and please please please start including an invoice with your details and the intended recipients and write the RTS on this ensures the recipient has a way of contacting you, and ensures you double check the details.

I have one request - please don't make the forum aware of this until Wednesday as I have been advised it may be interesting/entertaining,

It seems he has finally come to his senses, probably after reading the 18 page long topic I created on OcUK aswell.
