Nvidia Gets Sued Over GTX 970 False Advertising

Only person who wins in this are the Lawyers, consumers may get what maybe 5$ back? Anyone who thinks this will stop this kind of practice is completely naive, Nvidia knew exactly what they where doing with their marketing and technical info and it payed off dividends for them the GTX 970 sold by the bundle, lets face it this lawsuit wont cost them a fraction of the profits they made therefore they have no incentive never to try this tactic again, even with the scandal and the lawsuit they still come out ahead which is all there shareholders/CEO/Multi-National Corporation care about, add to the fact that people sold their 970's and upgraded to 980's only adds credibility to their decision from a business standpoint, I dont really think this inicdent will prevent the vast majority of consumers from still buying Nvidia in the future.

Bottom line is, never buy bleeding edge ANYTHING on release, "Caveat Emptor, Let the Buyer Beware"

P.S. I just purchased a GTX 970, should have it in a couple days, thankfully I knew all the limitations prior to purchase, I can understand the frustration felt by owners but hopefully we will all learn from this and to scrutinize items before spending allot of hard earned monies on them only to be dissappointed and potentially out of pocket.
 
I hope they this goes through and if they lose perhaps it will trigger the eu trading commission to fill their boots as well.

I returned both my 970 gaming cards to ebuyer for a full refund and grabbed a pair of strix 980's but I lost £100 on my waterblocks :(

If NVidia were to lose it could trigger a whole load of actions against both AMD and NVidia.

The only losers in this would be the customers as they would end up paying even higher prices as AMD and NVidia pass on their costs.

Fortunately I don't think anyone has a chance in hell of winning a case against NVidia for the 970 fiasco.
 
I hope this does go through mainly just so companies in the future will give accurate details about their products.

Yes it's still a good card but it's like being sold a car that's advertised as having 600BHP that does 150MPH, You test it and it does indeed do 150MPH but after a while you find out the manufacturer lied to you and it only has 450BHP, You'd be royally pissed off.

Of course it is and I don't like that Nvidia did it. Although there's still a question why they did it, what are the circumstances of doing so, I am definitely not liking the fact that someone is going for some easy cash by exploiting it.

But that's probably because I always see Americans as those with the lawsuit/patent court wars.

Its also about the ROP issue.
Yeah. This is a bit worse because in the case of RAM there's still 4GB of it, although divided. For SMM and ROP there's less than advertised. It's still in the same boat though.
 
I doubt the guy suing Nvidia has the money to hire lawyers anywhere near the level Nvidia can afford or the backing of a whole legal team like they have.
Would be nice to see something come of it though :)

The whole PC industry is full of lies, manipulation and clever marketing tactics to deceive consumers. As Kap said, if this was successful it could start a chain reaction

I'm wondering why we havent' heard anything from the EU comission for Fair Trade. The matter wouldn't just go away like that (if it ever will in the US case)
A few months ago, Intel was ordered to pay a multi-million fine because they had been trying to stop AMD products from reaching re-tailers inside the European Union countries.

Yeah i would have thought the EU would be on it already, but if they are not getting on it soon then nvidia gets a clear cut and dry escape which would be pretty bad. But the eu is quite slow with these matters, it took them ages to fine microsoft for that browser selection business and intel for paying of retailers to not sell amd products.
 
Nvidia losing this case will affect the entire PC market, CPUs, Memory, etc.

It will all have a knock on effect.

How so really?, I mean I know they're one of the 2 major graphics vendors, but why such large wide variety of PC components?...
 
Dont know about warchilds comment, however I find it rather doubtful that the this will go in the accusers favor.
 
haha, indeed. No system is fool proof. Nonetheless with the qualifications Nvidia and Gigabyte have pay for, rather slim for the accuser.
 
If this goes through it will be a win for us as consumers. Companies needs to be taught a lesson when bending or breaking the rules. As for Gigabytes involvement, there isn't a snowballs chance in hell that they didn't know about this issue so in my honest opinion they are just as guilty in this matter.

As others have stated I'm also concerned that a large donation of dollars under the table will make this matter disappear quietly but for every consumer out there who uses their hard earned money on their systems I hope not.

Yes and you can throw in ASUS, EVGA & MSI, Those companies can't come out and say we knew nothing about it IMO they knew all a long but Nvidia just told them Release it Release it

Of course they knew! They got the chips from nvidia, I'm sure they went through some QA to see if they work before they were soldered onto the pcb

So what if Nvidia raises their prices on their graphic cards, that only means that they will loose customers to AMD. Sure some die hard Nvidia fans will keep buying from Nvidia but with the fierce competition there is between manufactures at the moment, AMD will take advantage of the situation and why shouldn't they, if there is money to be made wouldn't everyone?

I'm really hoping that the 300 series card are going to be a game changer for AMD

Me and you both, although I'm a Nvidia fan/user I think it is about time that they get taken down from their high horse. How they can fail their own customers this badly and not realize people will feel betrayed by them as a company is beyond me.
