I'm pretty sure that a multi million/billion dollar R&D department wouldn't overlook a card specs as actually having less ROP's, Not a full 4GB chunk of memory as oppose to 3.5 and .5 unless they are extremely incompetent which I can't see, End result, False advertising.

Australian Consumer law says that if the product must 'match descriptions made by the salesperson, on packaging and labels, and in promotions or advertising'

If there's a minor problem the seller can choose to remedy it with a replacement (not applicable here really), repair (can't be done) or refund and compensation for loss.

IF the problem is major (ACCC website indicates amongst other items "is significantly different from the sample or description") you are guaranteed a refund.

Not sure whether they would see this as 'significantly different' or a minor packaging/printing error. That would be one to argue. The number of ROPS are wrong, the RAM is technically still 4GB although not utilised as you would have expected.

Check out the ACCC website or consumer affairs in your state/territory.

I phone PCCaseGear today and they said there are waiting for an Statement from Nvidia first, but they did tell me if Nvidia give the green light for returning items they will refund people's money, they all said just wait and see they gave me some BS about oh there could be a software/firmware fix.

EVGA are still the only manufacturer to make a statement, what's happened to MSI and ASUS??

For some strange reason they seem to have their heads in the sand with this one, unless there waiting on Nvidia to release this software/firmware which i don't think that will fix the issue

I what settings are you using for Dying Light. I ran a check last night with the 970 MSI gaming I had borrowed for curiosity in this whole matter. My FPS was ranging between 65 and 43 fps with Memory usage between 3.4 and 3.9gb.

Oh yeah i agreed with you dude, I think the companies knew all along and didn't say anything which was stupid for them to do esp for the likes of ASUS & MSI its complete horseshit, The longer ASUS and MSI leaves this makes them look more guilty.
 
I think I'm going to sell my case with all my watercooling, return both my 970's and sell their waterblocks and then buy a decent AIO and a pair of 980 kingpins
 
I just have to wait until the shop where i brought my from makes there mind up, hopefully they will allow returns and changed over to a 290 or 290X
 
I wouldn't use Dying Light as a way of testing this, google "dying light stuttering" lots of people are getting stuttering and on all different cards.

I'm going to do some more testing with other games today to see if going over 3.5gb actually does have an effect, but so far in Watchdogs it doesn't.

I'm curious. Why do you want Kingpins? they are intended purely for benching and Ln2 cooling etc.

But lets face it. It is almost impossible to test this properly using games as there are too many affecting factors and nothing is controlled. What one person represents will be different for another. My test of Dying Light for example was completely different to WYP. Although I don't know what his settings were. Would be nice to know so I can try the same.

I have it on Steam, just need to download it. I'll download it tonight and see if I can find other games to test.

I don't have Shadow of Mordor or any other games that will max the Vram, maybe FC4 but that is another game that people have stuttering problems on all kinds of different cards both AMD and Nvidia. Same with Assassin's Creed Unity.

They look nice and are clocked high but I will probably end up with a pair of classy's.

Just waiting to find out what the lowdown is with the 970 and what MSI offer before I put all my stuff up for sale on here. I spent over £700 on all my water cooling so I should only lose a few hundred off that and can reinvest

I'd suggest go with Classy. There is NO gain whatsoever taking a kingpin over a classy if you are keeping it on air/water.

Yep shouldnt take long. There are nice youtube vids out there showing which mods and which settings. All of which can be downloaded from Nexus.

But even so. Will it really represent accurate data, since you can make 980s in SLI stutter with the most extreme mods.
