I'd probably join the others saying "keep it", all's fair in love and free GPUs, but I also think that if I was actually in the same situation as Dicehunter it would be different and I'd contact them and let them know about the error.

Maybe it's all a ploy, they're seeing if you fail to return so they can keep your money and have effectively sold you another card

Hes a broken record repeatedly saying the same thing. Sadly even when i have him on ignore.. everyone quoting him makes me have to put up with his negativity still.

Anyway. Good for you Dice returning it. As you say, its not worth the bad karma ;)

After testing both the new Classified and the current Strix I have, I've decided to stick with the new Classified and get a refund on the 1080 Strix as I'm getting ever so slightly better clocks and temps on the Classified, Plus the Powerlink isn't compatible with the Strix ^_^

If you can return the strix then it's surely more cost effective too?
 
Here in Germany it's actually a crime/felony. If you receive something by accident it's your duty to report it to the seller. The chance of getting caught is not necessarily high, but if you are you are f'ed.

Had a friend who received 10 instead of 1 250gb 850evo. He did some research and after that contacted amazon. At least he got a 5€ store credit for his honesty.

I think he mentioned something like a hefty fine or even jail/probation could happen if you get caught.
 
maybe they sent it by way of apology for the messing about, worth contacting first to find out if it was an error or intended, nowt to lose and always a chance they may say keep it
 
Keep the new one if it clocks better than the refurb. I think you're obligated to send back one of the Classys but it's up to you which one. It's like when you find an extra 4 million dollars in your bank account - ok it's an extreme example but it happens. Keeping something you know is not yours is still fraudulent.

I'm on the Dicetrain with the Karma bus situation. It always bites me in the butt.

Just cause i said to return the GPU in the first place and trying to be honest with companies but noooo you can't be honest you have to try and rip the company off when they made a honest mistake.

And no i would be saying this even with another company.

Thankfully in the UK it's a bit different. Anything sent to you in error is classed as unsolicited goods, and falls under the unsolicited goods act.

If a business supplies unsolicited goods, the recipient has specific rights and obligations which the supplier must explain when delivering the goods. These include that:

the recipient is under no obligation to pay for the goods, unless they deliberately damage or lose them
the recipient must make the goods available for collection by the supplier for a 10 working day period after they receive them
if the 10 day collection period expires, the recipient can keep the goods as an unconditional gift and the supplier cannot take any action to recover the goods, or payment, from the recipient.
The recipient can also keep the goods as an unconditional gift if the supplier fails to tell them about their rights and obligations at the time they delivered the goods.

However, the recipient can’t keep the goods if:

they knew the goods weren’t intended for them (for example if they were addressed to another person)
or

they didn’t provide the supplier a reasonable opportunity to collect the goods within the 10 day collection period.
The Act does not define “reasonable opportunity”. We expect that this will be considered on a case by case basis and will depend on the nature of the goods supplied and the circumstances of the recipient. There is no requirement to make contact with the supplier and it may be sufficient to leave goods on your front doorstep or in another obvious visible place for collection.

Yep,

Case closed, thread closed, service log complete :)

Quite a lengthy process compared to just returning the faulty GPU to the shop but I ended up getting one back that is new which runs at like 20MHz higher so not bad ^_^

Now I just need to apply to get the optional thermal pads as this one came without them.
