got a reply from the store that they think the temp is a tad high and if the card fails they will replace it no question asked aslong as their is no physical damage to it.
so if the fan fails and the card overheats i will get it changed.
yes, overclocking voids warranty but they cant tell if i have done it or not as i use nvidia's own drivers to overclock so no bios changes has been made, and i seriously doubt it would be a problem if the card burns as they have a hard time checking if its been flashed.
i see some still writing about the airflow so just for the fun of it im going to remove the side and put a tablefan which pushes way over 100cfm blowing into the case.
if the card still gets hot then there is no question about bad airflow.
they also said i could come in with the card to have it checked but if their is nothing wrong i will be billed around 17€
they also said that i cannot reapply the heatsink with as5 and still have a valid warranty so will not do that either.
well, i believe that statement is false when talking about laws in my country.
i as customer is allowed to do alot and still have a legal right for warranty.
everything i buy has 3year "complaint right" so if i buy a psu and the manufacture says it should work for 100.000 hours and i get 1 year warranty and the fan brakes after 2 years i can claim manufacture error.
i like many of these laws that protects me as a customer even if it means prices gets alittle higher.

Hyper, 39 celsius isnt bad but i believe the gtx has a more advanced heatsink than the gt has.
