OK i finally cornered the problem! it's speed step! i read on intel's page that when speed step is one it'll scale performance to 0 and idle frequency at 800MHz, now the thing is , i can't seem to find speed step anywhere in the BIOS

FOUND IT!! another spin through the manual told me where it was, I've disabled it, but still the speed is at 800MHz i started writing a cd and for a second it cranked to 3.5GHz and back to 800MHz
