Ebuyer refunded partially for dodgy psu!!!

Hi,

I purchased a psu from ebuyer for £64 and i have had the item fro just over 6 months, (items has 3year warranty)well the PSU become faulty and did not supply any power one day.

Rang them up and they said sure send it to us and we will replace it. Sent it got a email saying you have been partially refunded and had £55 sent back to me (i know its only £9 but its still £9), so i rang them up and they said under the sales of goods act with it being over 180 days old they could only partially refund it.

One it was against what i was told i would get and secondly i found this on the BBC web page as part of a letter you can send for this case:

The Sale of Goods Act 1979 (as amended) states that when a consumer buys goods from a trader they must be: as described; of a satisfactory quality; and fit for any purpose made known at the time of sale to the seller.

This legislation also states that the seller, not the manufacturer, is legally obliged to sort out a problem if the goods do not meet these requirements.

The law also says I have six years from the date of purchase to claim damages for faulty goods.

My goods are not [delete as appropriate - as described/fit for purpose/of satisfactory quality] and I wish to claim a [delete as appropriate - repair/replacement/refund] of my goods under the Sale of Goods Act 1979 as amended.


Notice it says even if the item is over 6 month i can still demand a refund or replacement as the item was not fit for purpose, and of not satisfactory quality.

Now my question is Ebuyer says this is wrong and i say what is the point of having warranty if when the items are faulty inside the warranty, they want me to spend more money to get the exact same item again? where is the sense in that? I bought the item i did not rent it for a period of time from them?

What is my rights here please.

That doesn't sound right to me, they should give you a full refund. What model and manufacture is the psu? What is the current price for it on their website?

I had a recent problem with Play.com. I bought an active display port adapter and after 3 months it packed in, so I emailed them that I wanted a replacement. They said that as it was over 28 days that I had to deal with the maufacturer direct - yeah like that's gonna happen - so I won't buy any electrical items from them in the future. (yeah just bought this Intel chip and its faulty - sorry not interested phone Intel in the US and sort it out - yeah right), they can stick their customer service where the Sun don't shine.
 
ebuyer are normally really good with this kinda stuff honestly shocked, in my opinion they are only second to specialtech

are you sure the £9 wasnt their collection fees or anything?
 
Ive sent stuff back to ebuyer before with no problems normally very good id be miffed if I got knocked £9 as well

Strange i've never had problems with ebuyer before either they are usually very good.. But yeah I work on customer services in Morrisons ( I know not the same thing but yeah) and if a customer buys say a dvd player and it breaks within the 2 year warrenty even if its a month before the warrenty ends we have to give a full refund/replacment so i dont see how ebuyer are saying they can't.

Ask them to quote from the sale of goods act where it says they can only give you a partial refund.
 
I studied advanced business studies and business law. What they're doing is illegal.

They are breaking the Sales of Goods act. Ask them to specify where in the terms and condition of purchase that it states they can only offer a partial refund even though the product is covered by a warranty.
