quick motoring question for you:

whilst on my way home tonight i clipped the wing of a car that was parked less than 10 feet away from a junction on to a main road now I know that normally the driver of the moving car is at fault,but according to the highway code..

You MUST NOT leave your vehicle or trailer in a dangerous position or where it causes any unnecessary obstruction of the road.

* near a school entrance

* anywhere you would prevent access for Emergency Services

* at or near a bus or tram stop or taxi rank

* on the approach to a level crossing/tramway crossing

* opposite or within 10 metres (32 feet) of a junction, except in an authorised parking space

* near the brow of a hill or hump bridge

* opposite a traffic island or (if this would cause an obstruction) another parked vehicle

* where you would force other traffic to enter a tram lane

* where the kerb has been lowered to help wheelchair users and powered mobility vehicles

* in front of an entrance to a property

* on a bend

* where you would obstruct cyclists’ use of cycle facilities except when forced to do so by stationary traffic

so he was in the wrong for being parked there,and I know that some insurance companies these days are taking a very dim view of illegally parked cars and in some cases refusing to pay out

should I pin my hopes on the insurance telling him to take a hike for being illegally parked or should I expect a bill for the excess(500 quid).Normally I wouldnt be bothered but this close to xmas and with the current hard times,I dont want to be skint
 
Well if it's written there mate, use it as your proof. As long as the other driver won't lie that is. Do you have any witness of this accident at all? Some people get away with lies, but if your telling the truth and it states so there, I wouldn't worry personally.

Just expect the worst, hope for the best.
 
yes there were witnesses as this happened outside my local shops,also I had a passenger with me as well.When it happened I went into the local shops asking who owned the car and told them in front of a shopful full of customers that I had clipped it,everyone in the shop was saying how nice it was in this day and age for someone to admit it and not do a hit and run
 
hope so,can do without more big bills,the rental on the van has gone from 185 a week to 315 a week within a month!!!!!!!
 
I pranged a parked van that was about a metre from a main road once. I did give my details but I never heard back from the chap.
 
I work for an insurance company and even if a car is parked illegally, it doesn't give another driver the right to hit the car...

Had one where a car was half obstructing a drive and the other driver just drove straight into it. Even though that car is totally wrong for parking there, it was the other person who actually hit it.

How much damage is there to yours?

(You only pay the excess towards your own repairs you know). How much no claims you got - have you got protected no claims?
