AV Forums stupid mod

So the other day I was browsing AV Forums and saw that someone was selling DiRT3 on the PS3 at what I thought was a pretty decent price, so I duly put in an offer a quid below asking (cheeky) he accepts and we move to PM. At the same time that all this is happening I am looking for new flat to move into and after my first viewing get told that the letting agent fee is £200. Now I'm not made of money and £200 is a lot to me so I quickly PM'd the seller of DiRT3 letting him know that I would have to pull out of the sale because I need all the money I can so I can pay the letting agent fee, he replies saying that is ok and that he understands, crisis averted? No.

A few days later I receive an infraction from one of the mods for "withdrawing from a sale", something which surprised me as I had consent from the seller that it was ok to pull out and that he had put DiRT3 back up for sale.

So I messaged the mod back about the infraction, asking if he could look at my circumstances outlined in my message to the seller and could he remove the infraction because I felt it was a tad harsh considering my situation. He quickly replied saying that "That you could no longer afford the item is not a suitable explanation from withdrawing from an agreed deal."

Now to me this is a pretty good reason for pulling out of a sale, because otherwise how could the sale ever be made?

I replied giving more details of how I was trying to move flat, and asked the mod to consider the situation more carefully. The next reply was slightly annoying, pretty much claiming that I "should of known" (of which I didn't) about the letting agent fee and reminding me that pulling out of a sale will receive an infraction.

I got quite annoyed at this because I honestly didn't know about the letting agent fee until I was told, and as soon as I knew I let the seller know. What's more annoying is that the seller was ok with it, it wasn't a problem to him and yet the mod still saw fit to give me an infraction.

I've had infractions before but that was because I was being silly, in this case I was totally honest and I personally feel my situation was enough for the withdrawal to be overlooked. I would like to think that the mods on my favourite forum (OC3D of course!) would understand that circumstance took over, and that was that.

Would love to know if any mods on here would of done the same thing, or handled the situation differently, especially considering that something as small as this can affect the way someone experiences using a forum, and then tells their friends etc etc.
 
Depends on how strict they are with the rules. We are pretty strict here in that we want everything about a sale posted in the open, no sales via PM. If users violate these rules and they are caught, they get the ban stick.

Your situation sucks, I don't think you are in the wrong here, but if you had signed a contract (think ebay auction) for the item, you wouldn't be able to use what happened as an excuse.

I've seen on forums where a young member, maybe 14 years old, will commit to buy something. They then go ask for money from their parents and get told no, then must cancel their commitment. Having rules like what AV Forums has is trying to eliminate this type of situation. Unfortunately, as with all rules, there are exceptions and sometimes they can hurt people not meaning to break them.
 
How did I know the good people of OC3D would understand?! Hehe. He replied back saying the case was closed but I asked to talk with a senior mod to see what he thinks.

I get the feeling the guy just won't say sorry and remove the infraction because that would mean, well, saying sorry!

It's tough being a mod. Some people get angry rather quickly if you "mod" them. Sometimes it's just an explanation of a rule, but some forum users can get pretty defensive. Also, you need to treat everyone the same. If you are lenient on one person, then others may expect the same treatment even if the situations aren't the same.

With great mod powers comes great responsibility

Yeah I understand it's quite difficult at times, especially with annoying people like me buzzing around breaking rules all the time

To cut a long story short, their excuse was that I should of known something that I didn't.

It was a really great explanation, I laughed for at least 5 minutes
