Windows 7 Upgrade Confusion

I have Vista on my current computer, with 2 HDDs containing exactly the same data. I want to take one HDD and with a fresh SSD put them into my brand new built PC, and upgrade my Vista to 7, but onto the SSD and keep all my data on the HDD.

My main problem is that my bro is getting the old PC and wants to continue using Vista, so does that cause problems with my HDD having Vista on it also, is it essentially 2 PCs with Vista installed from the same disc?
 
If u have licence for one PC you can use it on one PC only mate, you wont be able to activate Vista if running on two.
 
Yep you won't be able to upgrade Vista to 7 on your SSD because Vista is on your HDD. I reckon back up what you want onto the HDD your taking by creating a partition, install 7 onto the SSD and in My Computer it will show your backup partition with your stuff.
