I think it may be to do with Nintendo's strict terms of service. They reserve the right to brick systems that they think are modded.

Not only that but also if they deem your account fraud. They basically are selling the hardware as a rental. There's no expiration date on their ToS and they can change their policies whenever they want to.

The console and games cost far too much IMO. Especially for such a locked down platform.
