Low GPU usage on 7970

Hi guys
Trying to play some GTA iV and my 7970 is only going to 50% usage then stopping. I'm getting about 40 fps on high/medium settings and 4x anisotropic.
Running 13.1 drivers.
Any ideas on how to get it to buck its ideas up and get it to work properly?

got the same problem with my 7950 in nearly all games. would you mind running MSI kombustor for me and check if the part with the flag has any black parts on the letters?
