thanks dude, i've never have something like this, i've always had to wait a long time to buy some thing new just to find out in a few weeks there something better coming out

If the seller is reputable, I'm sure there's nothing wrong with the CPU.

If its OEM cpu only etc youve probably bought one that been speed binned and known to be a crap overclocker......

what sort of overclocks and temps are you getting and on what cooler?

Built it friday .Ran at stock,hit OC Genie today.That set it at a mild 4.0ghz overclock.
Idle temps are 33 to 38c. Stress test max temp was 62c.
Case:CM Storm Trooper
Cooler:H100i with SP120 Quiet Editions in push
