Any ideas would be helpful thanks!

Can you take a screen shot of the disk management page please? I need to see if there is any unused space/ space that isn't formatted.

I don't think you can format the drive until the volume has been created.

Yea I would recommend right clicking on the drive in Disk management and selecting the option. New simple volume. Accept all of the default settings and see what happens.

Ah yeah, forgot about that.

EDIT: Open the command line and try disk part. Type "list disk" when disk part is initiated and tell us what that shows. Initialize the disk and copy something over to it if you haven't already, just to check if the available space is still at 32 GB.

Is the drive showing up in the BIOS? and if so is it showing up a 32GB OR 320GB?

um i doesn't show the size as it is counted as USB storage as it is plugged into my external hard drive cady, this couldnt be a problem because i have previously installed Ubuntu onto a hard drive of mine in the same way

I'm sure you've tried this, but I wanna make sure. Have you tried different SATA ports? Maybe try re-installing Motherboard chipset drivers?

Sorry dude, missed that it was in an external caddy. It could be the caddy?

If it's definitely not the caddy, then it's probably the hard-drive

i know im sure its not the caddy i use it for my Ubuntu system and portablilty so maybe the hard drive is broken from box? and in this case should they be able to just give me a new one ?

Check the drive on a sata port, there could be a compatibilty problem with your caddy ....
